Aerial imagery downloaded via the tile-server royalty free?

Does anyone know if aerial imagery downloaded via the tile-server can be used to create photo realistic scenery which can then be made available to the public as freeware or is it for personal use only?

Hello and Happy New Year,

I am not a lawyer, but up to now I have not heard of any instance where Google or another map server has gone after freeware developers. And there has been a lot of scenery made with these aeriel images over the last decade.

So, you probably need not worry.

I think Luis is right and you're safe, but I'd double check this. You don't want to put in a lot of work into something just to be DMCA'd.
